Code Files ITC Complaint Against Honeywell

SALT LAKE CITYJan. 10, 2018 /PRNewswire/ -- On Tuesday, Jan. 9, The Code Corporation of Utah, a leader in image based barcode technology, filed an antitrust complaint against Honeywell International Inc. (NYSE: HON). Code's filing alleges that the conglomerate engaged in anti-competitive behavior in the healthcare sector. Code filed the complaint before the U.S. International Trade Commission (ITC) against the giant corporation for violation of Section 337 of the Tariff Act of 1930 based upon violation of the antitrust laws. The complaint alleges, among other things, that Honeywell contacted Code's distributors, resellers and customers and made false and misleading statements in an effort to harm Code and monopolize the market for barcode reading technology in the healthcare field. Code is seeking relief including an exclusion order that would prevent Honeywell from importing its healthcare barcode readers into the U.S. and cease and desist orders which would prohibit Honeywell from selling or marketing its healthcare barcode readers. Code has also filed a related antitrust action in the U.S. District Court of the Eastern District of Texas seeking significant monetary damages.

"Fair competition along with free and open markets are the lifeblood of the American economy," said George Powell, president and CEO of Code Corporation. "Innovation is key in any industry, but even more so in the health care arena. Having a 'giant' willfully attack a supplier of our size in this market will ultimately hurt consumers, not only pricing wise but also in regards to innovation. We won't stand by and watch consumers and client businesses become collateral damage in a move designed as a shortcut to market success."

Code is represented by Scott J. BornsteinMark G. Davis, and Gregory J. Casas at Greenberg Traurig, LLP.
